Well, after trying to call, the phone lines are busy. I guess a lot of people around the country are probably trying to get through. It wouldn't suprise me. So, I decided to fax something, which may or may not be received. It goes as follows:
QUOTE
Senator Warner:
I have taken the time to write this because I hope you will decide to vote for the nuclear option after reading it. This vote is very important; as I’m sure you are well aware of.
There is a heavy partisan atmosphere in Washington these days, which makes it easy to lose sight of what is important. There is a lot of bickering over whether Democrats or Republicans have used the filibuster against judges in the past. This debate is misleading; it misses the bigger picture. Regardless of the actions surrounding a few of those cases, the filibuster has never been used, or threatened, against so many judges. (Especially judges that have had a simple majority of support in the Congress).
Recent developments should quickly illustrate the importance of the judiciary. It no longer simply interprets what the law says. Now many judges interpret what the law should say. These judges look to foreign law along side our constitution to make decisions. Finally, a judge in Nebraska, who I believe is a Clinton appointee, has said that their constitutional amendment, which 70+% of the state voted for, was unconstitutional according to the US Constitution.
Regardless of your stance, or mine, on gay marriage, something must strike you as odd that one man has thwarted the will of 70% of the people in that state. Furthermore, this case makes it clear why Democrats don’t want to have originalist judges appointed. The judiciary is currently filled with activists who support the same things they support.
What the Democrats have not done at the ballot box, they wish to do through the Judicial Branch of our government.
The only thing worse than a “tyranny of the majority” is a “tyranny of the minority.” The Constitution of the United States mandates that the Congress must advise and consent (vote), on judicial appointments.
The people elected Republicans over Democrats for many reasons in 2004. One of these reasons, which was big for me, was to appoint responsible judges. Please allow the process set forth in the Constitution to move forward.
Thank you so much for your time,
