Here is a MESSAGE TO FAIR TAX RALLY PARTICIPANTS

Bottom line, the only tax reform we need is for the people to demand their employees add the following words to our Constitution, bringing us back to our Founding Father`s original tax plan:

The Sixteenth Amendment is hereby repealed and Congress is henceforth forbidden to lay ``any`` tax or burden calculated from profits, gains, interest, salaries, wages, tips, inheritances or any other lawfully realized money___

See how easy real tax reform is? It doesn’t take 135 pages of NEWSPEAK and gobblygoo, [H.R.25] which would leave us on a sinking ship and entrench our nation with more socialism and big government…it only takes 32 words for the people of America to re-establish a fair system of taxation, our Founder’s original plan, which would also gain control of a runaway Congress!

Can you give us a reliable URL that clearly and accurately estimates what the taxation rate would be, what things would be taxed, how it ould be collected, how the govt. would ensure that nobody's cheating, how much revenue it would raise each year? Preferably, a statement audited by a CPA as to its accuracy?

Any direct tax by the federal government is illegal. All federal taxes must be apportioned. Ie. the gas tax or a VAT.
The IRS is operating outside the law.

bob, maybe you haven't heard of that recent amendment to the Constitution of the USA, called #16. It was only ratified on February 3, 1913. Now, if it had been improperly ratified, surely somebody would have challenged it successfully in court during the last 93 years, or at least before those 49 Zimbabwean nationalists blew up the World Trade Center buildings using tin foil and plastic model airplanes. Or whatever.

Pardon the sarcasm, above, please. If the income tax isn't legal, why is every challenge against it laughed out of court?

Back to the topic: what system of federal taxation could possibly replace the current one which is based upon income tax? Be careful; your answer or proposal could be off-base by a trillion dollars or so. Per year!

I'll be glad to give you a professional opinion about how to drastically SIMPLIFY the internal revenue code, which helped me to earn a living for 22 years. But if you eliminate the income tax system itself, you'd better come up with an ironclad method of taxation that's far, far better. Please, whoever knows of such, where's the URL complete with accurate, audited, professional estimates?

SURPRISE: Sean Hannity supports H.R.25 the alleged fair tax


It is so sad to see so many people in America, and especially those who participated in the unfair tax rally on Wednesday, ignoring our Constitution and looking for new ways to allow our domestic enemies on Capitol Hill tax and rape America`s labor and businesses.

Constitutional taxation requires the federal government to have jurisdiction over the subject matter being taxed. Taxation was one of the most, if not the most, important issue discussed during the framing of our Constitution and the framers intended to allow Congress to raise a federal revenue in a specific manner and for very specific and enumerated purposes!

The constitutional functions of our federal government were eloquently summarized in the following way:

Federalist Paper No. 45 tells us:


``The powers delegated by the proposed Constitution to the federal government are few and defined. Those which are to remain in the State governments are numerous and indefinite. The former will be exercised principally on external objects, as war, peace, negotiation and foreign commerce___. The powers reserved to the several States will extend to all the objects which in the ordinary course of affairs, concern the lives and liberties, and properties of the people, and the internal order, improvement and prosperity of the State.``

And, to support those functions, James Madison, speaking before Congress during the framing of our Nation`s FIRST REVENUE RAISING ACT states:


``___ a national revenue must be obtained; but the system must be such a one, that, while it secures to object of revenue, it shall not be oppressive to our constituents``


``Shall not be oppressive to our constituents!`` They went on to raise their revenue over a subject matter which they were granted jurisdiction over___ foreign commerce! And, they then selected specific articles and imposed a specific amount of tax on each specific article chosen for taxation!

In addition, they also laid what was know as tonnage taxes___ an across the board tax on imports to raise a revenue to fund the function of the federal government.

But that is not all, they also used their grant of taxing powers to promote the general welfare of the united States. No! The power was not intended to finance a food stamp program for permissive unwed moms, or pay for state constitutionally authorized functions such as public education, now done under the unconstitutional No Child Left Behind Act . Taxing for the general welfare of the united States meant imposing such taxes at our water`s edge which would promote America`s best interests!

And what did they do under the first revenue raising act to promote America`s best interests?

In addition to imposing a specific amount of tax on specific articles of
consumption which were imported, the first revenue raising Act also imposed an across- the-board tax on imports which was higher for imports shipped in foreign owned foreign built vessels, and discounted the tax for imports arriving in American owned American built ships:


"___ a discount of ten percent on all duties imposed by this Act shall be allowed on such goods, wares, and merchandise as shall be imported in vessels built in the United States, and wholly the property of a citizen or citizens thereof.``


This patriotic and skillful use of external taxation not only filled our national treasury, but gave American ship builders a hometown advantage and predictably resulted in America`s merchant marine becoming the most powerful on the face of the planet. Unfortunately, today when I visit the docks in New York`s Hell's Kitchen area, I am saddened that I can no longer read the names on the docked ships as they all seem to now be foreign owned foreign built vessels___ an irrefutable sign of America`s decline traceable to our domestic enemies on Capitol Hill.

Yes, there was a day when our national treasury was gladly filled by foreigners paying for the privilege to do business on American soil. But this was when members of Congress, and those running for Office, put American interests first and would have considered the NAFTA, GATT and the WTO as acts of sedition, and would have tarred and feathered those participating in the surrender of America`s sovereignty. And especially tar and feather those in Congress who now refuse to protect our borders from invasion.


Our country, is being stolen from us by a Congress in rebellion to our Constitution, who are assisted by uniformed self interested individuals who will swarm to a tax rally to support a tax which they believe will end calculating a tax from their income, but turns out to be another step to tighten the iron fist of government over the American People`s productivity.

How sad so many Americans have lost the spirit of freedom which our founding fathers intended to protect by a written constitution.

Neal Boortz should be ashamed of himself, promoting something which he knows will not do what its rallying supporters believe it will do.

Unfortunately, Sean Hannity has joined the ranks of the uniformed when it comes to tax reform and ignores what ``A GREAT AMERICAN`` would say with regard to tax reform:

``In matters of Power, let no more be heard of confidence in men, but bind him down from mischief by the chains of the Constitution``--- Jefferson

The 16th amendment is not repealed by H.R. 25!

Thanks for the historical note above, but what's the plan, Stan? Where's the URL that links to a surefire, no-bout-adout-it, fair tax plan that will continue funding the monster that is the US treasury?

There's got to be a better way, but what is it? I'll give you a brief summary of how to radically simplify the progessive income tax, but you folks don't want that. Therefore, your complete, total, perfect, immaculate plan is......what?

Or a friggin sales tax einstein!!!!!! For sake of arguement, the Income tax and the irs are evil and unconstitutional. The fair tax eliminates both. Why do you get your panties all knotted up over the Fair tax. Doesnt stop you from continuing to advocate for a constitutional amendment. MARK

H.R. 25 does not eliminate Congress’ power to lay taxes calculated from profits, gains, salaries and other income. The operative word is “eliminate”. H.R. 25, if it does anything, it merely suspends the taxes mentioned in H.R. 25 until and if a future Congress decides to start laying those taxes again.

The sad truth is, and I think you know it, if the power is there [to calculate a tax from income] Congress, especially a socialist and big government friendly Congress, will surely find a justification palatable to the general public to use it, e.g., to enact a small tax upon those evil corporations and wealthy scoundrels who make millions of dollars a year in profits by bleeding the poor working people, such as was alleged about Leona Helmsley who they sent to jail for an alleged tax fraud, but actually contributed more in taxes than any twenty average working people in New York.

It should be noted that the 16th amendment is not repealed by H.R. 25!

H.R. 25 states in clear language:

SEC. 2. CONGRESSIONAL FINDINGS.

(f) FINDINGS RELATING TO REPEAL OF PRESENT FEDERAL TAX SYSTEM-

Congress further finds that the 16th amendment to the United States Constitution should be repealed.

Did you see that? “Should” be repealed! Big difference between “eliminate” a tax calculated from income and “should” be eliminated.

Only a constitutional amendment may remove from Congress’ hands particular powers of taxation.

Exactly, ustrader, the bill will die in committee because it is almost entirely worthless.

Fix what's broken. Simplify a tax code which is more complex than brain surgery. Elminate all deductions, all credits, all complications and obfuscations and especially, eliminate the special exceptions to the exceptions to the general rules of the exceptions to the exceptions.

If you think I'm kidding, you didn't spend the same 22 years of having to read the Internal Revenue Code literally, more literally than an Hasidic rabbi reads the Old Testament, or a fundamentalist preacher reads the Bible.

The Amendment was constitutional, and appeals courts judges will almost literally throw you out of court or fine you if you waste their time arguing otherwise.

I read the link given in the article to the article mentioned in another link, and it didn't have a CBO estimate (that I could find) of whether this silly proposal would even raise a trillion dollars a year to substitute for the other taxes on income.

Realize, too, that this bill apparently fiddles with OASDI like Nero fiddled with Rome.

Here we agree! Fix what is broken. And who can deny it is Congress that is broken? No accountability and reckless borrowing which has enslaved the future of our nation’s children to the tune of $50 Trillion. Indeed, the servant has become the master over those who have created a servant, and the new servant pays tribute to a gangster government which ignores our most basic law…our constitutions, state and federal.

If you have any faith in the wisdom of our founding fathers, and desire the creation of tax reform carefully designed to promote good government and make members of Congress accountable for their spending and borrowing practices, I urge you to take the time to understand why the rule of apportioning a general tax among the states was agree upon by our nation’s founding fathers. There is a direct link between the kind of government we get and the manner in which we allow Congress to raise its revenue.

H.R. 25 would subjugate, just as present income taxation now subjugates, the important principle that taxation and representation among the states is to be adjusted by the same standard.

H.R. 25, just as income taxation, is based upon the idea from each state according to its ability___ an idea which is not compatible with a freedom loving nation, nor the intentions and beliefs under which our Constitution was agreed to. Our founding fathers gave us a written rule book based upon principles which do not change with the passage of time, and which made it possible for America to become the economic marvel of the world when it was followed.

I have summarized one of our founding father’s principles of taxation, the rule of apportioning a general tax among the states in THIS POSTat Hannity.com, and, at that link I have also provided ANOTHER LINK which quotes part of the debates from Madison’s Notes with regard to the important principle established by the rule of apportioning a general tax among the states___ a principle which socialists and the friends of big government fear with a passion, Representation with proportional obligation.

Hey, maybe that's a good point, to go back 200 years and try to get inside the heads of Madison, Jefferson, Adams, et al. No thanks. I don't really care, any more, what they thought might work, then. Pragmatism, the world's first philosophy born in the New World, has fully embraced my thinking. If it works, keep it. If it doesn't work, throw it out. Let's not worry about what might have worked partially in 1792; it's now 2006.

Please, show me what plan will surely work, absolutely positively, in year 2010, without bankrupting my SS pension, without impoverishing my first two kids who have done well economically, or my four kids who are roughly lower middle class.

And if it's difficult to understand, impossible to enforce, or impossible to predict its size and revenue, forget it.

You have been shown, but you choose to ignore it. the Founder’s Plan worked so well that by the close of the year 1835, the national debt [which included part of the revolutionary war debt] was completely extinguished and Congress enjoyed a surplus in the federal treasury from tariffs, duties, and customs. And so, by an Act of Congress in June of 1836 all surplus revenue in excess of $ 5,000,000 was decided to be distributed among the states, and eventually a total of $28,000,000 was distributed among the states by the rule of apportionment in the nature of interest free loans to the states to be recalled if and when Congress decided to make such a recall.
